Beyond the EACC Raid, Prosecution and Full Enforcement Must Follow

PRESS STATEMENT FOR IMMEDIATE RELEASE

The National Integrity Alliance notes the search operation conducted by the EACC on 4th June 2026 at the residence of Mr Patrick Analo Akivaga, Chief Officer for Urban Development and Planning at the Nairobi City County Government. 

The reported recovery of substantial sums of money, allegedly amounting to KES 65.3 million in cash, as well as critical documentary evidence, has generated significant public concern and continues to highlight corruption and economic crimes within the public sector. The serious nature of the allegations under investigation, including conflict of interest, abuse of office, bribery, and possession of unexplained wealth, reflects a broader governance challenge that requires sustained and systemic responses.   

While this operation represents an important investigative step, it is only one part of the broader criminal justice process. Public confidence in anti-corruption efforts will ultimately depend on the timely conclusion of investigations, institution of prosecution where evidence warrants, recovery of illicit assets and consistent enforcement of the law.  

The NIA now urges the EACC, in collaboration with the Office of the Director of Public Prosecutions (ODPP), to move with speed and diligence to ensure that: 
 

  • Investigations are concluded expeditiously and to the required evidentiary threshold for the prosecution. 
  • Appropriate charges are instituted where evidence supports prosecution;  
  • Parallel civil asset recovery and forfeiture proceedings are commenced in line with the Proceeds of Crime and Anti-Money Laundering Act (No. 9 of 2009) (POCAMLA Act) to preserve and recover the unexplained wealth and illicitly acquired assets; 

Beyond this specific case, NIA reiterates the urgent need for full and effective implementation of the Conflict-of-Interest Act, 2025. The proper enforcement of this Act should be leveraged to strengthen preventive and detective accountability mechanisms, including the institutionalisation of lifestyle audits for public officials. If effectively implemented, these tools would significantly enhance the ability of oversight institutions to detect and disrupt corruption pathways, especially those linked to procurement fraud, kickbacks, bribery and abuse of office.  

Closely linked to this is the need to accelerate full implementation of public procurement reforms and beneficial ownership transparency provisions under the Companies (Beneficial Ownership Information) Regulations, 2020. These frameworks are critical to exposing hidden interests in public contracting and reducing opportunities for diversion of public resources through opaque corporate structures.  

The instant case also reflects broader and persistent governance concerns within the county governments, where significant public resources are managed alongside recurring allegations of corruption and mismanagement. Over the years, several cases involving both former and serving governors and senior county officials have been investigated and prosecuted on allegations ranging from procurement irregularities and embezzlement to conflict of interest and unexplained wealth. These trends highlight the urgency of strengthening systemic safeguards at devolved levels of government.  

In this regard, the NIA calls for the integrated and consistent enforcement of the Conflict of Interest Act, 2025, Public Procurement and Asset Disposal Act, 2015, beneficial ownership disclosures, alongside strengthenedsocial accountability mechanisms. Enhanced civic participation in monitoring county budgets, procurement processes and expenditure tracking can play a critical complementary role in detecting early warning signs of corruption and reinforcing institutional oversight.

In his new role, he will be responsible for supporting all aspects of Strengthening Capacities of Local Civil Societies to Fight Corruption; Tupigane na Ufisadi (TUNU) PROJECT; to ensure successful implementation of the project deliverables on digital technologies and assisting in manning of the digital platforms, complaints reception and handling, data collection and analytics, reporting and documentation

Devaline is set to graduate with a bachelor’s degree in laws (LLB) from the University of Nairobi on 13/12/2024. Prior to joining Transparency International, Devaline has worked at Rabala and Company Advocates, The Nairobi Centre for International Arbitration, The Refugee Consortium of Kenya and First Assurance Company.

Diana Mwanzia

Legal Officer

Diana Mwanzia is an experienced Advocate of the High Court of Kenya with a passion and dedication to human rights, policy advocacy and social change. She has over 7 years of combined experience in litigation, human rights and policy advocacy. She has previously worked in private legal practice and worked with organizations such as Collaborative Centre for Gender and Development, East Africa Civil Society Organizations Forum-Kenya Chapter, Kituo cha Sheria and Federation of Women Lawyers (FIDA-Kenya). In TI-Kenya, she is responsible for supporting all aspects of legal matters, public interest litigation coordination, legislative drafting, and strategic advocacy initiatives to promote good governance and combat corruption. She holds a Bachelor of Laws Degree from Kenyatta University and a Post-Graduate Diploma in Law from the Kenya School of Law. She is currently pursuing Certified Secretaries (CS) course (Advanced Level).

James Kinyua

Philomena is a lawyer, currently undertaking the Advocates Training Program at the Kenya School of Law, following her attainment of a Bachelor’s Degree in Law (LL. B) from the University of Nairobi. She is also a Certified Professional Mediator (CPM).

With a keen interest in Human Rights, Policy, Democracy, and Governance, she is deeply invested in promoting equitable legal practices and advocating for social justice. Her professional journey includes valuable experiences from (Coulson Harney LLP) Bowmans Law and ENS Africa, where she developed a solid understanding of legal intricacies and demonstrated proficiency in navigating complex legal landscapes. Beyond her legal pursuits, Philomena actively engages in community service through volunteer work with local CSOs, aiming to extend her impact beyond the legal sphere and contribute meaningfully to societal progress.

Thomas Juma

Project Assistant, North-Rift Region

Thomas is a dynamic professional with a wide range of experience and skills in community mobilization, capacity development in governance, media engagement, networking and partnership development. In his new role, he shall be responsible for offering support to the North Rift Regional Office to ensure successful implementation of the projects and assisting in logistical tasks, data collection and documentation. She has over 15 years’ of experience in strengthening organizations ‘capacities for sustainable program delivery through integration of best grants and financial management practices and compliance with different donor rules and regulations including USAID, UKAID, DANIDA, GCERF, SIDA and EU among others.
